ACORD Certificate Changes

Largely in response to regulatory pressure from several states, ACORD has expedited the publication of new versions of its ACORD 24 and ACORD 25 certificates of insurance forms. The changes to these forms could comprise the single most dramatic revision in over 30 years. This webinar examines the major changes and related marketplace issues.

They say that 13 is unlucky, so perhaps that explains why ACORD swiftly went through the working group process following the 13th edition of the ACORD 25 certificate of insurance in January 2009. This group produced a new September 2009 edition that incorporates possibly the most significant changes since the ACORD 25 was introduced in November 1977. This form’s speedy revision more likely resulted from at least three states’ concern with the cancellation clause language based on recent regulatory directives.  Click here for the Webinar outline.

  Nonprofit Executive Liability Series

Unlocking the Mystery

This course provides an overview of the operations of nonprofit organizations and the protections available to those organizations through the executive liability policy.  Participants will learn about nonprofit organizations’ liabilities and exposures, including board member actions creating liability, volunteer liabilities, and other sources of claims from volunteer and certification activities.  It will offer suggested risk management procedures to prevent losses arising from these activities.  The presentation will include analysis of the combined D&O and EPLI policy wording, with emphasis on policy provisions common to both coverages.   Participants will gain a working knowledge of the defense and settlement provisions, application of the limit of liability and retention, operation of the extended reporting period, and the importance of the application warranty and severability provisions.

Nonprofit Executive Liability Series 2

The Mystery Solved

This course begins with a description of the manner in which the economy, employment trends and claims statistics impact the operation and liabilities of nonprofits. Participants will analyze wording of the definitions and exclusions applicable to both the directors and officers and employment practices liability coverages.  Topics will include definitions of insured, claim, wrongful act and publishers’ liability. Prior and pending litigation, bodily and personal injury, breach of contract and fraud exclusions will be explained.  The Directors and Officers and Employment Practices liability coverage sections will each be analyzed individually through use of sample policy provisions.  As a result of the analysis, participants will obtain a working knowledge of the coverages, exclusions, modifications and supplemental policies available to expand coverage. The session will conclude with suggestions for developing and analyzing quotations and use of a spreadsheet, with sample provided, for comparing quotations.
